These Terms of Use ("Terms") govern your use of the mobile applications published by Tomtoro ("we", "our", "us"). By downloading or using any of our apps, you agree to these Terms.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use our apps on Apple devices you own or control, in accordance with the Apple Media Services Terms and these Terms.

In-App Purchases

Some of our apps offer in-app purchases processed entirely by Apple through the App Store. The following terms apply to in-app purchases:

• One-time purchases: Apps that offer "lifetime" or "Pro" one-time purchases grant you access for the lifetime of the app on your Apple ID. We do not guarantee the app will remain available indefinitely; "lifetime" means for as long as the app is published and operable.
• Subscriptions: Where offered, auto-renewable subscriptions automatically renew at the end of each period unless canceled at least 24 hours before the end of the current period. You may manage and cancel subscriptions in your Apple ID settings.
• Family Sharing: Where enabled on a product, one purchase covers your Apple Family group as defined by Apple.
• Refunds: Refunds are issued by Apple, not by us, in accordance with Apple's refund policy.
• No payment information is processed by or transmitted to Tomtoro; all transactions are handled by Apple.

Your Content

You retain all rights to content you create or import into our apps — including client records, notes, photos, voice memos, dream entries, mood entries, and any other user-generated data. We claim no ownership interest in your content.

Where an app processes your content on a remote service (such as the AI features in MoodThread, Somnia, TalkTidy, and Velvet), that processing is performed solely to fulfill your request and the content is not retained beyond the duration of each request. See our Privacy Policy for details.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of our apps, except as permitted by applicable law.
• Use our apps to violate any law, infringe third-party rights, or process content that you do not have the right to process.
• Attempt to bypass in-app purchase mechanisms, paywalls, or volume caps.
• Use our apps in any manner that could damage, disable, overburden, or impair the App Store or any infrastructure used to deliver the app.

App Updates

We may release updates, bug fixes, new features, or remove features at any time. You agree that we have no obligation to maintain any specific feature in any specific version of any app.

Disclaimer of Warranties

Our apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the apps will be uninterrupted, error-free, or that defects will be corrected.

Apps that generate reminders, schedule notifications, or store time-sensitive data (such as JobFollow, Drowse, and Somnia) are intended as supplemental tools. You are solely responsible for any business, health, or other decisions made based on data managed by our apps. We are not responsible for missed appointments, forgotten tasks, lost revenue, or other consequences of relying on app-managed reminders.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tomtoro be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising from your use of or inability to use our apps. Our total liability for any direct damages shall not exceed the amount you paid for the app in the twelve months prior to the claim.

Termination

These Terms apply for as long as you use our apps. You may stop using our apps at any time. We may discontinue or remove an app from the App Store at any time. If your use of an app violates these Terms, we may revoke your license to use the app, though Apple controls actual removal of installed apps.

Changes to These Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated date. Continued use of our apps after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the user's place of residence to the extent required by applicable consumer protection law, otherwise in the United States.
